Gwyneth Paltrow’s lawyer complains after filming the actress in court
The retired ophthalmologist who took actor Gwyneth Paltrow on trial for a skiing collision has claimed he can no longer enjoy wine tasting due to the injuries he sustained in the crash.
The Hollywood star and CEO of Goop has been accused of running into Terry Sanderson, 76, on a ski slope at Deer Valley Resort in Park City, Utah, in February 2016.
Mr Sanderson claims Paltrow slammed him in a “full body blow” leaving him with “a permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.
Meanwhile, Paltrow claims that it was Sanderson who bumped into her.
Neuroradiologist Dr Wendell Gibby testified on Wednesday that the impact left him suffering a “sudden” drop in quality of life – leaving him unable to enjoy himself.
“Terry was an energetic, high-functioning person…meetings with groups, wine tastings, skiing, volunteering,” she said.
“After the accident, his condition suddenly deteriorated and many activities that he loved to do, he stopped doing.”
Sanderson is seeking $300,000 from Paltrow, while she is seeking $1 in damages and to cover her legal fees.
Treating Sanderson’s brain injury was like ‘boot camp’, expert says
Dr. Fung, who treated Mr. Sanderson, said he underwent 32 hours of therapy for weeks in hopes his brain could recover from the injuries he suffered in his collision with Ms. Paltrow.
“The treatment was very intense…it was boot camp,” Dr. Fong testified.
“It was so much fun. Every day he had at least one hour of cognitive therapy, speech therapy, occupational therapy, neuromuscular therapy, vision…psychotherapy.”
“And then I filled in the rest of those hours before and after filming.”

A ski crash victim was encouraged to travel after an accident by a neuropsychologist
Under cross-examination by Sanderson’s attorney, Dr. Fong said she had advised Mr. Sanderson to travel.
“I encouraged him to try to get back to doing the things he loves,” Dr. Fung said. “I warned him he shouldn’t be traveling alone because of his memory issues and other problem-solving issues.”
“But I strongly recommended that he try to get back to doing the things he loves,” she added.
During opening arguments earlier this week, Paltrow’s attorneys tried to poke holes in Sanderson’s allegations by arguing that his injuries could not have been as severe as he claimed if he had been able to travel to “more than a dozen countries” after his 2016 skiing collision.

Expert says Mr Sanderson was ‘exemplary patient’
When asked by Mr. Sanderson’s lawyer if there was any chance she thought he was nursing, Dr. Fung said, “Nothing at all.”
Dr. Fung described Mr. Sanderson as an exemplary patient who devoted 32 hours of his week to treatment. Sanderson’s cognitive skills and family life had been affected, she said, and by the time she began his treatment, his former enjoyment of life had “gone”.
Terry showed up to every appointment on time. Dr. Fong testified that he did his best.
“The treatment we’re doing is very intense, so it would require Terry to be on time every morning.”
“He was someone who didn’t want to get sick and was doing everything he could to make it better.”

Dr. Fung says the consequences of the ski crash on Sanderson’s brain are likely to be permanent
Dr Fung testified Thursday that despite her optimism, there was significant concern that Mr Sanderson’s brain functions would not return to what they were before the accident.
“He worked really hard, he really did his best,” said Dr. Fung, who treated Mr. Sanderson for six years. “We’ve noticed some definite improvements but speaking to him now, knowing where he is now, it’s clear he’s still struggling.”
She added, “We’re getting to the point, I mean, he’s 76 years old, and I’m concerned that some of these issues are long-term.”

Dr. Alina Fung was the first witness called on the stand Thursday.
Dr. Fung said that before opening her clinic in Utah, she opened a practice in Boston in partnership with Tom Brady.
She testified that when she began treating Mr. Sanderson, he was suffering from persistent post-concussion symptoms a year and a half after the accident.

Terry Sanderson heard “hysterical screams” before impact
Mr. Sanderson claims that Ms. Paltrow was descending the novice slope of the Bandana Run on Flagstaff Mountain in an “out of control” manner, According to Court TV.
He claims she hit him so hard he got kicked out. In a press conference in 2019, he said that moments before the collision, “He heard this just hysterical screaming like… King Kong in the jungle or something”.

He said at the time that he believed the speed at which Ms. Paltrow was bitten could explain the extent of his injuries. “A small bullet can make a big hole,” he said Salt Lake Tribune.
At that press conference announcing the suit, Mr. Sanderson said he noticed a number of large “slow down” signs as he headed down the Bandana run, so he slowed but stayed with the stream of other skiers coming down the slope.
“It was just instantaneous,” he said in 2019. “I hurt my back. … I felt like it pushed me forward.”
He said he remembered not being able to control himself as he went down.
“Then that’s all I remember up to that point—just outside,” he said.

Terry Sanderson’s daughters to testify today
The two daughters of the retired ophthalmologist suing Gwyneth Paltrow are expected to testify Thursday about the lasting effects of their father and the 2016 Paltrow ski collision as the trial takes an increasingly personal note on the third day of proceedings.
Lawyers are expected to call Polly Grasham and Shay Herath to the stand and question them about the broken ribs and permanent brain damage their father, Terry Sanderson, claims suffered after he and Paltrow crashed at one of North America’s most prestigious ski resorts seven years ago.
Neurologist Richard Boehm and Paltrow may also be called to testify on Thursday or Friday.
