A Florida woman is attacking Hershey's, claiming it “deceived” customers with “misleading” packaging on Reese's seasonal chocolates.

Cynthia Kelly, of Tampa, is suing the chocolate giant for $5 million because she claims the packaging and actual contents did not match.

For example, the pumpkin-shaped chocolates do not have eyes and a nose as the packaging suggests, and the football-shaped shape resembles an egg, according to the lawsuit filed in the Middle District Court of Florida.

“Hershey’s product labels are materially misleading and many consumers have been deceived and misled by the images on product packaging,” said the lawsuit, seen by The Post.

“This is a class action against The Hershey Company for misrepresenting several Reese's Peanut Butter products as containing clearly sculpted artistic designs when no such sculptures exist in the actual products,” the lawsuit states.

The bizarre lawsuit came after Kelly bought a pumpkin-shaped candy from Aldi for $4.49, believing it “contained a cute sculpt of a pumpkin mouth and eyes as shown on the product packaging.”

She said she would have left the chocolate behind if she had known the carved face wasn't already on Reese's bite-sized piece.

“The Reese's Peanut Butter Pumpkins product purchased by Plaintiff did not contain any of the artistic sculptures of the mouth or eyes as depicted on the label,” the lawsuit states.

The lawsuit includes not only pumpkins, but also ghosts, bats, footballs, snowmen and bell-shaped candies, many of which are depicted in the suit.

She also claimed that Reese's packaging was not always “deceptive” and that “two to three years ago” the products matched their packaging and did not display faces.

Kelly also cited several YouTube videos, where The creators claimed that Reese “lied” to him them and “failed” to deliver it.

The class action will cover “all consumers within the state of Florida who purchased a product.”
