A New York University doctor, who was allergic to nuts and dairy, died in October last year after eating at a Disney restaurant in Florida, despite staff assuring him that the food was allergen-free.
Her husband has filed a lawsuit blaming employees for the negligence that led to his wife's death, according to a report In the New York Post.
In his 19-page lawsuit, Jeffrey Piccolo, husband of the late Kanokporn Tangsuan, accuses Walt Disney Parks and Resorts of negligence as he claims his wife told waitstaff she had a nut and dairy allergy.
The incident occurred on October 5 when the couple was having dinner at Raglan Road Irish Pub and Restaurant in Disney Springs. Tangsuan repeatedly explained that she had an allergy to certain food items, after which the staff assured that they could prepare allergen-free food. After eating broccoli, corn fritters, scallops and onion rings, Tangsuan and her husband went to a shopping mall where she began to feel sick.
Upon entering Planet Hollywood, the soon-to-be deceased had difficulty breathing and collapsed. Although she was given an adrenaline pen immediately, she died at a local hospital.
According to court papers, the coroner's investigation showed that death was caused by “high levels of dairy and nuts in her system.”
The newspapers also claimed that Disney advertises its ability to cater to people with food allergies and claims that food allergies are a “top priority” at its parks and resorts.
However, the lawsuit alleges that Disney “failed to educate, train, and/or instruct its employees” to “ensure that foods indicated as allergen-free or required to be made allergen-free were, in fact, allergen-free.” “.
